Special Education Law Blog: OSEP Rules re Mediation and Consent ...

I am a fan of mediation as a mechanism for resolving special education disputes. Unlike due process hearings or state complaints, mediation is well suited to deal with the relationship issues that arise in these conflicts.? We are talking about the education of a child, and as we know, it takes a village...

You can hear and actually see me address this topic and others as a part of "Voices From the Field," a collection of viewpoints from people in the special education dispute resolution field. The videos are located on the CADRE website.? You can find mine here.

The federal Office of Special Education Programs has reiterated that IDEA mediation cannot be used in the situation where a parent revokes consent for special education services.? The regs already say that, but I wondered whether mediation could be used if the goal was not to override the parent, but instead to insure that the revocation decision was based upon informed consent if the parents agreed.? OSEP said no, that IDEA mediation could not be used even if the parents agree.? Letter to Gerl (OSEP June 6, 2012).? By the way, this is the second Letter to Gerl so now I'm really famous! Autographs are available!

Sleek & lightweight for discretion & convenience

Two new products from Motorola Solutions meet the customer brief for a

lightweight product with a sleek and stylish appearance, combined

with rugged performance.

?

MOTOTRBO SL Series digital radio

To develop the MOTOTRBO SL Series, Bruce Claxton, Motorola Solutions senior director of design innovation, travelled the globe to listen to customers. The response was demand for a product that had style, refinement and a premium look. Most importantly, it had to be smaller than anything Motorola Solutions had ever done before.

The result is the incredibly thin and light ? it weighs as little as your average smartphone ? MOTOTRBO SL 7550 portable radio, the ultimate in discreet communications. Versatile and powerful, this device is designed to meet communication needs in the hospitality, services, security and airport industries.

With advanced features such as Intelligent Audio, integrated Bluetooth and covert mode, end-users can provide superior customer service and faster response times, discreetly and professionally.

Russell Penton, security and health and safety officer at Claridge?s Hotel in London, agrees: ?The radio needs to be small so that it?s not obvious to any of our guests that I?m wearing a radio, and also because we do such long shifts. We do 12 hours plus on our shifts. The more comfortable and lightweight the radio is, it?s of benefit to us as an end-user, definitely ? The new radios themselves are quite a leap forward. It?s the biggest step forward that I?ve seen in my years as a radio user.?

Ruby Mountain, receptionist at Claridge?s Hotel, concludes: ?The MOTOTRBO SL Series is fantastic. It?s really lightweight, it?s very easy to use. A lot of the times when we communicate with the luggage porters ? the guests are actually standing in front of us, so it?s difficult to do in a subtle way. But the SL Series really helps with that because it?s very small and it?s very convenient.?

CLP analogue portable radio

CLP, the latest business class two-way radio is here! The CLP solves those common user complaints of two-way radios getting in the way, being too uncomfortable to carry all day long, or that users have no place to attach them.

Designed specifically for retail, hospitality, and restaurant environments, the CLP is small and lightweight. Minimal training is required with a simple one-button, push-to-talk operation. Clear, strong audio makes communicating easy even in the noisiest restaurant. The design is sleek and contemporary, yet durable, and the long battery life will stand up to the everyday wear and tear of any fast-paced business.

Flexible carry options include a belt or lanyard to match the workplace environment. A unique magnetic clothing mount even enables attachment, such as on a lapel, apron, shirt or uniform, for those whose business attire precludes a belt.

New Book Teaches Wise Retirement Planning and How to Pay As ...

How should you invest your money? Should you contribute to your company?s 401k, put the money in a Roth IRA, or just buy mutual funds? Can you expect to receive any money from Social Security when you retire? How much of your retirement money will the IRS take in taxes? These are the important questions Rick Rodgers expertly answers in ?The New Three-Legged Stool? with clear explanations, followed by practical, concise instructions to make the most with the money you have. This tax-efficient approach to retirement planning is one that readers will refer to again and again.

?The New Three-Legged Stool? refers to the three types of investments you should have, and balance properly to support your retirement. These three investments are Tax-Deferred Savings, After-Tax Savings, and Tax-Free Savings. Rodgers takes the reader through an explanation of why each of these types of savings is important, how to invest in it, and how to withdraw the money to achieve the maximum benefit at the time of retirement. Tax-Deferred Savings include company 401(k) plans and IRAs (including SEP and SIMPLE plans). After-Tax Savings include mutual funds, bank and brokerage accounts, and investment real estate-anything that isn?t technically a retirement account. Tax-Free Savings are Roth IRA?s and Roth 401(k)s that have no immediate tax benefits. Rodgers devotes considerable time to explaining the benefits and disadvantages of these investments, and why a healthy balance must be achieved among all three.

One of greatest strengths in ?The New Three-Legged Stool? is the examples it offers in the form of various retirees? stories. The book opens with ?The Un-Funniest Story Ever Told? about a successful businessman with an estate worth over $4.4 million. Because the man never consulted a retirement planner or made an effort to do estate planning, when he passed away, his children ended up paying 85.8% of their father?s retirement account in taxes! Many more examples of retirees? experiences are illustrated in the book, often comparing two people?s strategies to see which ends up being more beneficial.

Besides telling readers how to manage their money according to the current IRS tax laws, Rodgers provides an explanation of how the IRS functions, why it tries to get as much money as possible, based on the U.S. Government?s failure to handle its money properly, and the origins of Social Security, as well as the approaching crisis that by 2017 more money will be withdrawn than is annually contributed to Social Security.

Rodgers closes with advice on finding a good retirement advisor and how to do estate planning, including writing a will or setting up a trust to protect your hard-earned money so you will have enough for the remainder of your life and money left over for your heirs. Several useful charts accompany the discussions, illustrating how much money a person will need to live on, depending on current income, age of retirement, expected longevity, and when a person chooses or is required to draw income from various retirement accounts, including Social Security.

Rick Rodgers has produced a much-needed, well-organized, friendly to read, and refreshingly short book (202 pages) that will give readers much to think about and plan for, and which they will return to time and time again. I hope Rodgers will update the book as time goes by so it is current and future readers can equally benefit from it as tax laws change.

Rick Rodgers is well qualified to provide advice on tax-efficient retirement planning. He is an industry veteran of twenty-five years, has published numerous articles on investing in such publications as Wealth Manager, been a guest on TV and radio shows, and been quoted in ?Investment News? and ?Smart Money? magazine. In 1996, he founded Rodgers & Associates ?to help families create and conserve their wealth in preparation for worry-free and dignified retirements.? (AP) ? Islamist Mohammed Morsi was declared the winner Sunday in Egypt's first free presidential election in history, closing the tumultuous first phase of a democratic transition and opening a new struggle with the still-dominant military rulers who recently stripped the presidency of most of its powers.

In Tahrir Square, the birthplace of the uprising that ousted autocratic President Hosni Mubarak, joyous Morsi supporters wept and kneeled on the ground in prayer as soon as they heard the outcome announced live television. They danced, set off fireworks and released doves in the air with Morsi's picture attached in celebrations not seen in the square since Mubarak was forced out on Feb. 11, 2011.

Many are looking now to see whether Morsi will try to take on the military and wrestle back the powers they took from his office just one week ago. Thousands vowed to remain in Tahrir to demand that the ruling generals reverse their decision.

"I pledge to be a president who serves his people and works for them," Morsi said on his official web page. "I will not betray God in defending your rights and the rights of this nation." He was scheduled to address the nation Sunday night in his first speech after being declared president.

The White House congratulated Morsi and urged him to advance national unity as he forms a new government. White House press secretary Jay Carney said Morsi's victory is a milestone in Egypt's transition to democracy after decades of authoritarian rule under Mubarak. The Obama administration had expressed no public preference in the presidential race.

Left on the sidelines of the political drama are the liberal and secular youth groups that drove the uprising against Mubarak, left to wonder whether Egypt has taken a step towards becoming an Islamist state. Some grudgingly supported Morsi in the face of Ahmed Shafiq, who was Mubarak's last prime minister, while others boycotted the vote.

Morsi will now have to reassure them that he represents the whole country, not just Islamists, and will face enormous challenges after security and the economy badly deteriorated in the transition period.

Pro-democracy leader Mohammed ElBaradei urged unity after the results were announced.

"It is time we work all as Egyptians as part of a national consensus to build Egypt that is based on freedom and social justice," he wrote on his Twitter account.

The elections left the nation deeply polarized with one side backing Shafiq, who promised to provide stability and prevent Egypt from becoming a theocracy. Because of his military career, many saw him as the military's preferred candidate.

In the other camp are those eager for democratic change and backers of Morsi's Muslim Brotherhood who were persecuted, jailed and banned under Mubarak but now find themselves one of the two most powerful groups in Egypt.

The other power center is the ruling military council that took power after the uprising and is headed by Mubarak's defense minister of 20 years.

Just one week ago, at the moment polls were closing in the presidential runoff, the Supreme Council of the Armed Forces (SCAF) issued constitutional amendments that stripped the president's office of most of its major powers. The ruling generals made themselves the final arbiters over the most pressing issues still complicating the transition? such as writing the constitution, legislating, passing the state budget? and granted military police broad powers to detain civilians.

"I am happy the Brotherhood won because now the revolution will continue on the street against both of them, the Brotherhood and the SCAF," said Lobna Darwish, an activist who has boycotted the elections.

Also, a few days before that constitutional declaration, a court dissolved the freely elected parliament, which is dominated by the Muslim Brotherhood, leaving the military now in charge of legislating.

Brotherhood members and experts said the results were used a bargaining chip between the generals and the Brotherhood over the parameters of what appears to be a new power-sharing agreement. The country's new constitution is not written and the authorities of the president are not clear.

This is the first time modern Egypt will be headed by an Islamist and by a freely elected civilian. The country's last four presidents over the past six decades have all came from the ranks of the military.

"Congratulations because this means the end of the Mubarak state," said Shady el-Ghazali Harb, a prominent activist who was among the leaders of the protests in January and February last year.

The results of the elections were delayed for four days amid accusations of manipulation and foul play by both sides, raising political tensions in Egypt to a fever pitch.

The delay plunged the country into nerve-wrecking anticipation and pushed tensions to a fever pitch. Parallel mass rallies by Shafiq and Morsi supporters were held in different parts of Cairo and cut-throat media attacks by supporters of both swarmed TV shows. In the hours before the announcement of the winner, the fear of new violence was palpable.

Heavy security was deployed around the country, especially outside state institutions, in anticipation of possible violence. Workers were sent home early from jobs, jewelry stores closed for fear of looting and many were stocking up on food and forming long lines at cash machines in case new troubles began.

Morsi, the 60-year old U.S.-trained engineer, narrowly defeated Shafiq with 51.7 percent of the vote versus 48.3, by a margin of only 800,000 votes, the election commission said. Turnout was 51 percent.

Farouk Sultan, the head of the commission, described the elections as "an important phase in the end of building our nascent democratic experience."

Sultan went to pains to explain the more than 400 complaints presented by the two candidates challenging counting procedures and alleging attempts of rigging. It appeared to be an attempt to discredit claims that the election commission was biased in favor of Shafiq, the candidate perceived as backed by the military rulers.

The country is deeply divided between supporters of the Brotherhood, liberals and leftists who also decided to back them as a way to stand up to the military, and other secular forces that fear the domination of the Brotherhood, and grew critical of it in the past year. The small margin of victory for Morsi also sets him for a strong opposition from supporters of Shafiq, viewed as a representative of the old regime.

Naguib Sawiris, a Coptic Christian business tycoon who joined a liberal bloc in voicing opposition to the Muslim Brotherhood a day before the results were announced, said he expects the new president to send a reassuring message to Egypt's Christian minority who represent around 10 percent of the population of 85 million.

"There are fears of imposing an Islamic state ... where Christians don't have same rights," Sawiris told the private TV station CBC. Morsi "is required to prove the opposite. ... We don't want speeches or promises but in the coming period, it is about taking action. ... He was not our choice but we are accepting it is a democratic choice."

Hamdeen Sabahi, a leftist presidential candidate who came in a surprising third place in the first round of elections, asked Morsi to live up to his pledges to form a national coalition government and appoint presidential aides from different groups "that express the largest national consensus."

Khaled Abdel-Hamid, a leading leftist politician, said Morsi must fight to get his powers back or he will lose any popular support he may have garnered.

"If he fights to get his power back, we will support him. But if he doesn't fight back, then he is settling for siding with the military," he said.

Sandusky lawyers raise appeal issue on timing

BELLEFONTE, Pa. (AP) ? Jerry Sandusky's lawyers said they tried to quit at the start of jury selection in his child sex abuse trial because they weren't given enough time to prepare, raising an argument on the trial's speed that could become the thrust of an appeal.

And one of the jurors who convicted Sandusky of 45 child sex abuse counts said Saturday he was swayed by the "very convincing" testimony of eight accusers who said the retired Penn State assistant football coach molested them for years.

"It's hard to judge character on the stand, because you don't know these kids," juror Joshua Harper told NBC's "Today" show. "But most were very credible ? I would say all."

A day after Sandusky's conviction, his lawyers disclosed Saturday they felt too unprepared to adequately defend him because of how quickly the case was brought to trial. Experts have said the seven months between Sandusky's November arrest and trial was fast-paced by Pennsylvania standards.

"We told the trial court, the Superior Court and the Supreme Court we were not prepared to proceed to trial in June due to numerous issues, and we asked to withdraw from the case for those reasons," attorney Joe Amendola told The Associated Press.

The issues included a scheduling conflict with a defense team member and the need to read a cache of documents produced by a lengthy grand jury investigation. Judge John Cleland denied their request.

The attorneys raised other issues that could be part of the future appeal, saying a mistrial was sought and denied over a repetition at trial of a brief part of a November interview Sandusky had with NBC's Bob Costas.

Jurors in the two-week trial convicted Sandusky of 45 of the 48 counts against him, meaning Sandusky, 68, likely will die in prison.

Harper said the accusers who testified one by one of horrific abuse at Sandusky's hands were each believable, "but then also the fact that we saw this corroborating story between all of them. It was very convincing."

Then Sandusky's impassive face when the verdict was read was confirmation for the jury, he said.

"I looked at him during the reading of the verdict and just the look on his face. No real emotion," he said, "because he knew it was true."

Harper said jurors had some issues with the testimony of Mike McQueary, a then-assistant who said he saw Sandusky assaulting a boy in the Penn State showers in 2001; jurors acquitted Sandusky on one count relating to the incident.

The case is poised to move to an investigation of university officials' role in reporting the charges; two ex-school administrators face trial on charges they didn't properly report McQueary's account of the suspected abuse in 2001.

Almost immediately after the verdict, Penn State President Rodney Erickson signaled an openness to quickly settle potential civil lawsuits arising from the convictions, saying the school "wants to provide a forum where the university can privately, expeditiously and fairly address the victims' concerns and compensate them for claims."

The university recently reported a $1.8 billion endowment. But both sides have reasons not to want to go to court, said Jason Kutulakis, a Harrisburg-area lawyer who specializes in child welfare and juvenile law. Victims are reluctant to get on the stand and have their credibility attacked, he said.

But "Penn State's got so much egg on their face, they probably just want to make it all go away," he said.

For now, the school is facing one lawsuit from an accuser, Travis Weaver, who was not among those represented in the criminal case against Sandusky.

Lawyers for McQueary, who testified against Sandusky, have signaled their intent to sue, along with a lawyer for one accuser, so-called Victim 5.

Jeff Anderson, who represents Weaver, said that he represents more victims of Sandusky's and that he will ask the court to allow him to begin seeking information from Penn State in Weaver's case.

The next step is to determine the extent of Penn State's culpability, lawyers say. In part, that means finding out who in the university's upper ranks knew Sandusky was preying on boys and could have stopped it.

The former Penn State officials facing charges, athletic director Tim Curley and retired vice president Gary Schultz, are charged with lying to a grand jury about what they knew of a 2001 incident in which McQueary said he saw Sandusky assaulting a boy in a football team shower.

A separate investigation by ex-FBI director Louis Freeh, who was hired by Penn State's board of trustees to investigate the university's handling of the Sandusky allegations, is due later this summer.

Hall of Fame coach Joe Paterno was fired for a failure of leadership for not going to the police after McQueary told him about that incident. The scandal also caused the departure of university president Graham Spanier.

Philadelphia-based lawyer Fortunato Perri Jr., who followed the trial, said the jury's dismissal of the charge involving the 2001 shower incident could help Curley and Schultz' defense.

"You've now had a jury kind of preview your case with respect to the credibility of McQueary, and they didn't believe him," Perri said. "Who knows if the next jury would believe him or not believe him?"

But the administrators' attorneys would probably be precluded from introducing the acquittal evidence at the separate trial, Perri said.

Sandusky's sentencing is expected to occur in about three months; an exact date hasn't been set. Because of the severity of the charges and mandatory minimum sentences, he faces an effective life sentence.

Until his next court date, Sandusky is one of 272 inmates at the Centre County Correctional Facility, seven miles from the Penn State campus. He was kept under watch overnight and is allowed access to some personal items including a prayer book, and can get visits from family, friends and attorneys.

Rominger said he planned to visit him on Sunday.

Greece seeks to win Germany's respect at Euro 2012

GDANSK, Poland (AP) ? Now for the really important business between Greece and Germany: Football.

On Friday, thousands of fans from the two nations at opposite ends of the eurozone financial crisis are converging on neutral Polish turf for a European Championship quarterfinal match.

For Greece fans, Friday's clash in rainy Gdansk inevitably mixes sports and politics, Euro 2012 and the euro currency.

They seek respect for their country after its humiliating economic collapse ? and the German government's role in imposing strict austerity measures.

"It's not good that sports and politics are together, but today we have no other choice," said Greece fan Michalis Kalotrapesis, wearing a white national team shirt and tracksuit top. "We are playing for our country and for our image in Europe and all over the world."

Kalotrapesis, and three Greek friends who now live in Germany have driven through the night to support their native nation here.

Their pride in performing what they see as a patriotic duty fits into Greece's favored national narrative: In football as in finance, Germany is the traditional power and Greece the spirited underdog.

"We are a little bit crazy, but it's the Greek mentality," said Nikos Barzas, pointing out the bloodshot eyes of the group's designated driver, Georgios Kotiniotis.

They left Gifhorn, near Wolfsburg, at midnight with 750 kilometers (about 465 miles) of road ahead of them. In a city center cafe, the first coffees of the day were helping them bridge the 10 hours to kickoff.

German Chancellor Angela Merkel's journey to Gdansk will surely be more comfortable. Merkel will attend the match after morning economic meetings in Italy that were brought forward to help fulfill her role as the supposed lucky charm of the national team.

Barzas is glad she is coming ? to further spur the team and 5,000 Greece fans expected to attend the match.

"(The players will) fight a little bit more because (they want) to beat Angela Merkel. (It would be) a little bit of a small kick in Germany's (backside)," he said.

About 15,000 Germans were expected to go to the match, according to the Football Supporters Europe group. Many of the Germans were arriving at Gdansk's main train station, with scalpers leading those without tickets to a nearby shopping center. The asking price was ?200 (about $250) for a ticket with a face value of ?75 ($95). There didn't appear to be any Greek fans in the market for them.

Two days after being sworn into office, the prime minister of Greece's new conservative-led coalition will stay at home to work.

Antonis Samaras, a Harvard-educated former finance minister, is better employed stabilizing the country after a tense election last weekend than cheerleading at a football match, fan Thomas Nikolopulos said.

"I'm glad they are at home," said Nikolopulos, who arrived with his son Daniel in Gdansk on a Friday morning flight from London.

Nikolopulos, who is originally from Athens, said the feeling back home is that "Germany has put them in the corner" over the euro currency crisis.

"This is Greece's opportunity to stand up and try to go back to being historical wonders," he said, with a blue-and-white striped national flag draped across his shoulders.

Greece fans takes faith in their team's surprise run to be Euro 2004 champion, founded on the same solid defense and dogged resistance shown by the current team in Poland.

For three-time European champion Germany, the match seems more routine ? its fourth straight quarterfinal at each World Cup and Euro since Greece's golden year.

"For me, it's a normal football match," said German fan Klaus Lehmkuhl, a technical consultant from Muenster. "I don't think the politics is important for the German team. They are football players, not politicians."

Still, some off-field tensions are expected when the German national anthem is played minutes before the match begins.

"We will respect it. But the (hardcore fans) from Greece, I don't think they will," Barzas said.

In Berlin, a German deputy government spokesman was peppered with questions about the match and asked whether, in view of the eurozone crisis, Merkel would feel the need to tone down any goal celebrations.

"It's hard to assess that in advance," Georg Streiter said. "I think it depends a bit on how the game goes, but I think you will see that she is glad if there's a goal on the right side."

Streiter also shrugged off a question as to whether Merkel would consider herself partly responsible if she doesn't bring luck to the team and German loses.

"I think you would be loading up the chancellor, who already has plenty of packages to carry, with an unjustified package," he said. "She's a spectator."

Romney faces Latino group amid immigration debate

(AP) ? Mitt Romney is taking an economic-focused message directly to Hispanic leaders, facing a large gathering of the influential voting bloc for the first time since immigration was thrust into the forefront of the presidential contest.

The presumptive Republican presidential nominee on Thursday is addressing the National Association of Latino Elected and Appointed Officials in Lake Buena Vista, Fla. President Barack Obama will speak to the same group Friday.

Romney has struggled in recent days to clarify his immigration policy as he pivots from the harsh rhetoric that defined the monthslong GOP primary to a general election audience in which Latinos will play a critical role. The stakes are high not only for states with larger Hispanic populations such as Florida, Nevada and Colorado, but for a growing number of other battlegrounds ? Ohio, North Carolina and Virginia, among them ? where even a modest shift among Latino voters could be significant.

At least 1 in 6 Americans is of Hispanic descent, according to the Census Bureau.

"We're talking about a significant share of the American electorate that could well decide this election," said Arturo Vargas, executive director of the Latino association. "It's only now that both candidates are turning their attention to the Latino vote."

Romney's speech comes as the Supreme Court prepares to render judgment on a get-tough Arizona law and after Obama announced plans to ease deportation rules for some children of illegal immigrants.

Obama is riding a wave of Latino enthusiasm over his decision to allow hundreds of thousands of illegal immigrants to stay in the country and work. Under the administration plan, illegal immigrants can avoid deportation if they can prove they were brought to the United States before they turned 16 and are younger than 30, have been in the country for at least five continuous years, have no criminal history, and graduated from a U.S. high school or earned a GED or served in the military.

The new policy could help anywhere from 800,000 young immigrants, the administration's estimate, to 1.4 million, the Pew Hispanic Center's estimate.

Romney has refused to say whether he would reverse the policy if elected, but he has seized on the temporary status of Obama's plan as his prime criticism. The Republican has also highlighted what he calls the president's "broken promises" to deliver comprehensive immigration reform during his first term.

"These people deserve to understand what their status will be long term, not just 4 1/2 months," Romney said on Fox News Radio this week. "And that's why I think it's important for me and for Congress to come together to put together a plan that secures the border, that insists that we have an employment verification system and that deals with the children of those who have come here illegally on a long-term basis, not a stopgap measure."

Both sides are crafting aggressive strategies to appeal to a demographic that is by no means monolithic but has supported Democrats in recent elections. Some Republicans fear ? and Democrats hope ? that Obama could capitalize on this moment to help solidify Hispanic voters as predominantly Democratic this fall and for years to come, much as President Lyndon Johnson hardened the black vote for Democrats as he pushed the Civil Rights Act of 1964.

As is typical, Romney intends to focus on the economy when he faces the Latino convention. The former Massachusetts governor argues that his economic credentials would benefit all people who have struggled under Obama's leadership in recent years ? women, younger voters and Hispanics among them.

That's a message that resonates with Latinos, according to Vargas. "Overall, what's on the minds of the folks who will be gathering here is the state of the economy ? the need for more jobs," he said. "Latino workers have suffered."

Regardless of his focus, Romney's appearance will draw attention to his recent rhetoric on the issue.

Facing a Rhode Island audience in April, for example, Romney drew large cheers when he said: "We want people to come here legally. And we like it when they come here speaking English."

He did not support the Obama administration's lawsuit challenging Arizona's hard-line immigration law. And he said that he would veto the DREAM Act, which would have given legal status to some children of illegal immigrants.

Obama so far has vastly outspent Romney on Spanish-language television and radio. But Romney has released targeted TV and radio ads in Spanish, including some that feature one of Romney's sons, a fluent Spanish speaker.

Romney is set to leave Florida later Thursday en route to a three-day retreat with fundraisers in Utah.

WEST LAFAYETTE, Ind. (AP) ? With Indiana hemorrhaging revenue during the Great Recession, Gov. Mitch Daniels targeted higher education to help fill the gap ? including nearly $30 million in state cuts at Purdue University.

On Thursday, trustees there unanimously approved him as the school's 12th president. Students, faculty members and legislators wondered how the governor would transition to a new job with such starkly different duties ? particularly considering he still has six months left in his old one.

Daniels said it will involve a lot of listening. The former White House budget director and Eli Lilly executive has a Princeton bachelor's degree and Georgetown law degree but virtually no experience working in academia.

"I don't even know what I don't know yet. All I know is there's a lot I don't know," he told about 100 students at an afternoon gathering on campus.

Besides segueing from budget hawk to higher-ed advocate, the change for Daniels also will be extreme in the world of politics. The outspoken conservative was once considered such a rising star that many Republicans encouraged him to seek the presidency ? or at least make himself available as a potential running mate or Cabinet choice for presumptive nominee Mitt Romney.

He said his appointment means he won't be involved in partisan politics after making one last out-of-state appearance this weekend.

"No campaigning, no commenting about anybody's campaigning ? in the state or out state or anywhere else ? no fundraising, nothing. I won't be a delegate to the national convention," he said.

Daniels, 63, will take office in January once his second term as governor expires.

That sudden withdrawal from the political spotlight is a sharp change for Daniels, who has written op-ed pieces, spoken on Republican causes to gatherings of conservatives, been a fixture on Sunday morning news shows and delivered the GOP's response to President Barack Obama's State of the Union address this year.

The stance is one of necessity. University presidents need to be able to unite, not divide, said Robert Bontempo, who teaches executive education at the Columbia Business School in New York.

"You can't give people orders and tell them what to do," he said. "You have to lead by consensus, because they have lifetime jobs."

Bontempo said politicians tend to make the transition to university leadership more successfully than private sector executives. He cited Bob Kerrey, a former governor and two-term senator from Nebraska who is running for the Senate again after 10 years as president of the New School for Social Research in New York City.

Since 2009, Daniels has ordered more than $150 million in cuts to public education ? about one-fifth of that to Purdue. Adam Hoover, a 2008 Purdue graduate who is organizing a public protest over Daniels' selection, said he thinks Daniels is hostile to the cause.

"It's disturbing that one man could both cut the budget of a public university and control the exact impact of those cuts," Hoover said in an email to The Associated Press.

The university also came under fire from state lawmakers over its tuition increases at the height of the recession. Purdue's in-state tuition rates have risen by as much as 62 percent since 2004, according to figures provided by the university.

As governor, Daniels approved a new right to work law that angered unions and signed off on a law that would cut most public funding to Planned Parenthood because it provides abortions. He also pushed through the nation's largest school voucher program, drawing fire from critics who said using taxpayer money so students could to attend private schools violated the constitutional separation of church and state.

"I don't think he has a proven track record in terms of being able to get the job done and doing things the right way," said Tim Neuhaus, 28, of Baltimore, Md., who graduated from Purdue in 2010 with a bachelor of science degree and works as a project engineer for a commercial construction company.

Mindy Anderson, 33, who is seeking a doctorate in pharmacy and teaches veterinary classes at Purdue, said she thought Daniels was a great choice because of his leadership skills. She said she wasn't concerned that he had cut higher education spending in the past.

"He didn't do it irresponsibly. I think he did his homework and got the information he needed and did what he needed for the financial health of the state," she said.

Daniels won't be in a position to decide on allocations to Purdue during the remainder of his term as governor because the Legislature does not reconvene until January.

But Rep. Scott Pelath, D-Michigan City and a member of the budget-writing Ways and Means Committee, questioned whether Purdue would be treated more favorably than other state-supported universities when the Republican-dominated General Assembly is making appropriations.

"What do the folks in the inner sanctum of Indiana University or Ball State University have to say? Do they think they're going to be treated the same way?" Pelath said. "It would be foolish not to look down the road and consider the possible implications."

Daniels will have to win over faculty and students who question whether having him appointed by a board he largely appointed poses a conflict of interest. Some also are leery of his lack of academic experience and his reputation for shaking up the status quo.

Morris Levy, a biological sciences professor who just completed a term as University Senate chairman on June 1, said some faculty worried that Daniels might lower the school's academic standards. He pointed to the governor's support of the Legislature's recent decision to limit the number of college credits state university students need to earn a degree.

"The intrusion of politics into the academy is something everyone ought to be wary of," Levy said. "But he does bring enormous skills to the job we haven't previously had."

Purdue officials said they anticipated some negative reaction to Daniels' selection but said support was overwhelmingly in favor of his appointment to succeed France Cordova, who will step down in July after five years at Purdue's helm.

"He's a visionary. He's a strategist. He's an innovator. But most of all, he's a doer," said Trustees President Keith Karch.

MIT thaumaturges work to turn any windowed room into a camera obscura

MIT thaumaturges work to turn any windowed room into a camera obscura

Those interested in criminology, forensics or the basics of voyeurism probably have a decent grasp on what a camera obscura is. For everyone else in the audience, allow us to explain. Used since way before your birth, these chambers are designed with an optical device that projects an image of its surroundings on a screen; you just need a room with a hole in one side, which allows a fine amount of light to pass through. If you've ever watched [insert crime drama here], you've probably seen those magical investigators take a blurred shot of a room wall, zoom it in and somehow draw conclusions about the origins of life. Now, MIT's own Antonio Torralba and William Freeman have developed a method that can "transform the entire setting into a pinhole camera." In other words, any room with a window can be repurposed for forensics. On that note, you should probably consider moving your... operations center to a windowless bunker, STAT.

Texas doctor accused of Medicare, Medicaid fraud gives up license

Associated Press

Posted on June 18, 2012 at 1:17 PM

DALLAS (AP) ? A North Texas doctor accused of running a scheme to defraud Medicare and Medicaid of nearly $375 million has surrendered his medical license.

Jacques Roy is in federal custody on charges that he signed off on thousands of claims to bill the federal government for services that weren't necessary or weren't done. In an order released Monday, the Texas Medical Board said Roy had agreed to surrender his license to practice medicine in the state.

The order says the 54-year-old Roy does not admit or deny the federal allegations against him, but agreed to a settlement to avoid a possible lawsuit.

Roy's attorney did not immediately respond to a message seeking comment.

In all of these techniques, energy is created through the spinning of a turbine. As its name indicates, hydro energy is created when water is used to whirl a turbine that then changes this spinning into energy. Based on where you are situated, this may account for a very large or very small part of the Finnish energy intake in your position. Regardless of how much it records for, any electric professional can discuss with you just how important having different resources of energy is.

How Does It Work? Dams are used in a lot of all hydroelectricity development. With regards to the scenario, the wind flow stream wind turbines required to generate energy will be exclusive by either loading or dropping water. The energy that is created is then directed into the local utility, just like any other way of energy. It can then be handled and used by everyone who is related. When it gets to your home, it is then allocated due to the attempt of the electric professional who set up your power system.

Another way that hydroelectricity is created is through the use of water aquariums that are kept on different levels. In most situations, this is only used to generate energy when there is an extreme level of need. To generate energy this way, water will be launched from greater aquariums through wind flow stream wind turbines into reduced aquariums. Unwanted energy is then used to push the water back up to the top and do it again.

Why is Hydroelectricity Important? One of the most eye-catching factors of hydroelectricity is the fact that it maintains a mostly ongoing cost. Moreover to keeping a quite ongoing cost, hydroelectricity is also a very maintainable and long-lasting power source. Furthermore, most domestic electricians will tell you how important it is to have many different kinds of energy in any given power system. When any given position is determined by only one way of energy development, the prospective for prolonged energy unable is much greater. By producing energy through substitute means, the stability of any power collections is improved and supported in the occurrence that one source is briefly not available.

By preparing constant expenditures and maintainable increasing, hydroelectricity has properly secured its position as an important energy source. Although it can only be collected in places that are well suitable for its development, hydroelectricity currently makes up around 3.4 percent of the planet's Finnish energy and nearly 21 percent of its finish power. As the concentrate goes from kinds of to more different ways of energy development, we are sure to see a more highly effective concentrate placed on substitute techniques such as trend, solar power and wind flow stream energy.

(AP) ? Barry Bonds. Guilty on a technicality. As least that's how much of the public sees it. It's all that came out of a seven-year investigation into baseball's home run king.

Lance Armstrong. Not even prosecuted. A two-year, multi-continent investigation brought to a close this year with no charges filed.

Now Roger Clemens. Acquitted on all counts. A five-year investigation ended with the top pitcher of his generation celebrating with family hugs inside the courtroom.

After three expensive failures, the government is done, it seems, with the business of pursuing high-profile cases of drugs-in-sports ? with a track record not worth bragging about.

"It was a tremendous waste of federal resources," said Stanley Brand, a long-time Washington defense attorney who was counsel to the House of Representatives from 1976 to 1983. "The juries that acquitted these people weren't persuaded by any of this. That's the man on the street."

With the government striking out yet again, the policing of drugs in sports now falls to other entities. The U.S. Anti-Doping Agency filed formal accusations last week against Armstrong that could strip the cyclist of his seven Tour de France victories. Armstrong denies any doping.

Clemens, 49, was acquitted Monday on all six counts that he lied to Congress when he denied using performance-enhancing drugs. The government had been pursuing him since 2007, when he was first mentioned in the Mitchell Report on drug use in baseball, and he famously and vehemently disavowed any link to steroids and human growth hormone at a nationally televised hearing in 2008.

Clemens' lawyers derided the hearing as a "show trial," and even some members of Congress at the time questioned the validity of the proceedings. But then-President George W. Bush had made the problem of drugs in sports a talking point ? even mentioning it in his State of the Union address in 2004. The FBI and Justice Department pursued a perjury case against the former pitcher that eventually involved 93 federal agents and officers. It carried over into the Obama administration, albeit without the head of the Justice Department's criminal division, who stayed out of the case because he had represented Clemens at the hearing.

Attorney General Eric Holder also took no part in the case because he had worked at a firm representing Clemens.

Brand questioned why the aggressive federal investigators weren't reined in.

"Where was the adult supervision from the Justice Department to control these individual prosecutors from trying to make hay out of things that didn't fit the big picture?" he said. "They contorted federal statutes to try to convict these guys."

In the end, the government could only find one person who could claim firsthand knowledge of Clemens' using performance-enhancing drugs. He was a flawed witness, something even prosecutors acknowledged. Longtime strength coach Brian McNamee said he injected Clemens with steroids in 1998, 2000 and 2001 and with HGH in 2000, but his story changed over the years and his only physical evidence was kept haphazardly in a beer can.

Yet the case came to trial. The public perception that the government had better things to do was evident during jury selection, when many prospective jurors felt the congressional investigation was a waste of taxpayer money. One man used the word "excessive" to describe the 2008 hearings ? and he actually made it onto the final panel of 12 jurors.

The trial that lasted into its 10th week yielded less than 10 hours of deliberation over several days. After the jury foreman uttered "not guilty" for the sixth and final time, Clemens teared up. He and his four sons gathered in the middle of the courtroom, arms interlocked, like football players in a huddle. Then Clemens kissed his wife, Debbie, who was a defense witness in the case.

When Clemens went outside to speak to reporters, he fought hard to hold back tears.

"I put a lot of hard work into that career," said Clemens, who won 354 games in 24 seasons with the Red Sox, Yankees, Blue Jays and Astros and took home an unprecedented seven Cy Young Awards. "And so again I appreciate my teammates who came in and all the emails and phone calls. Thank y'all very much."

Clemens was charged with two counts of perjury, three counts of making false statements and one count of obstructing Congress. He did not take questions after his brief statement.

The jury of eight women and four men declined comment through a court spokesman. One juror, however, told the New York Daily News the panel was troubled by the prosecution's reliance on McNamee. "We just could not believe that they even called their key witness, the drug dealer," Joyce Robinson-Paul said.

The U.S. Attorney's Office for the District of Columbia issued a statement thanking the jury and respecting the judicial process, but it will be hard for prosecutors to put any kind of positive spin on another disappointing Justice Department outcome.

The investigation into Bonds yielded a guilty verdict on only one count of obstruction of justice in a San Francisco court last year, based on an evasive answer he gave about injections. The jury deadlocked on whether Bonds lied to a grand jury when he denied knowingly taking performance-enhancing drugs. He was sentenced to 30 days of house arrest and two years of probation; the sentence was suspended pending an appeal.

The Clemens outcome also comes on the heels of the Justice Department's failure to gain a conviction in the high-profile corruption trial of former presidential candidate John Edwards.

In addition, the first attempt to try Clemens last year ended in a mistrial when prosecutors played a snippet of video evidence that had previously been ruled inadmissible.

"I think he's gone through enough," said former Virginia Rep. Tom Davis, who was the top Republican on the House Government Reform Committee when Clemens testified in 2008. "We did the appropriate thing in referring it over to Justice. But hopefully this will put it behind him. He's a good citizen."

The panel's chairman at the time, Rep. Henry Waxman, D-Calif., also defended the decision to refer the conflicting testimony it heard to the Justice Department, but said, "Whether Mr. Clemens committed perjury is a decision the jury had to make and I respect its decision."

This may well be the end of an era in which sports stars are prosecuted for getting involved with performance-enhancing drugs, said Ty Cobb, a former coordinator of the Justice Department's Mid-Atlantic organized crime and drug enforcement task force.

But Cobb, a long-time Washington defense attorney and a distant relative of baseball Hall of Famer Ty Cobb, felt the cases against Bonds and Clemens were warranted. "Lying to Congress is a serious matter. Lying to a grand jury is a serious matter, and the Justice Department should pursue those crimes without fear of losing when they think they occurred," Cobb said.

Clemens' lawyers contended that the pitcher's success resulted from a second-to-none work ethic and an intense workout regimen dating to his high school days. They said that Clemens was indeed injected by McNamee ? but the needles contained the vitamin B12 and the anesthetic lidocaine and not performance-enhancing drugs.

Said Clemens' lead lawyer, Rusty Hardin: "This trial was the first chance we had to let somebody on his behalf question the accusations and what we knew were the wrong perceptions of him as a person. It got to where people thought arrogance was a man saying, 'I didn't do it.' When a man says he didn't do it, let's at least start out giving him the benefit of the doubt."

As for Clemens, the verdict is unlikely to settle the matter in sports circles as to whether he cheated in the latter stages of a remarkable career that extended well into his 40s ? during a period in which performance-enhancing drug use in baseball was thought to be prevalent. Clemens himself told Congress at the 2008 hearing, "No matter what we discuss here today, I'm never going to have my name restored."

A crucial barometer comes this fall, when his name appears on the Hall of Fame ballot for the first time. His statistics would normally make him a shoo-in for baseball's greatest honor, but voters have been reluctant to induct premier players ? such as Mark McGwire and Rafael Palmeiro ? whose careers were tainted by allegations of drug use.

"I hope those in the public who made up their minds before there was a trial will now back up and entertain the possibility of what he has always said ? using steroids and HGH is cheating," Hardin said, "and it was totally contrary to his entire career."
